A promise that every guideline we set is in place to support and protect your experience with us.

- [I. General] -

By using the BOOMM website (boomm.au) and/or the BOOMM mobile app (collectively, the “Site”), you agree to comply with and be subject to these Terms and Conditions, including our Privacy Policy. This agreement is between you and BOOMM Pty Ltd trading as BOOMM (ABN 52 655 116 233) (“BOOMM,” “we,” or “us”).

- [II. Ordering through Our Site] -

✔️ By placing an order through our Site, you are making an offer to purchase the selected product(s) at the displayed price (including applicable taxes and fees).

🔞 You must be 18 years or older to place an order. BOOMM will not process any order unless you verify that you are of legal drinking age.

📝 You warrant that all information provided during checkout is accurate and truthful.

BOOMM reserves the right to refuse or cancel orders at its sole discretion, including for suspected fraud, incorrect information, or non-compliance with liquor laws.

- [III. Personal Information] -

We collect personal information as part of order processing. Our Privacy Policy details how we collect, use, store, and disclose your data, and how you can request access or make a complaint.

- [IV. Order Acceptance & Rejection] -

✔️ BOOMM reserves the right to accept or reject any order, including cancellations under Clause IX.

📄 Each accepted order forms a binding agreement between you and BOOMM. Orders are processed only at our licensed premises and are subject to all relevant liquor laws.

You acknowledge that:

🚫 It is illegal to purchase alcohol on behalf of a minor.

🔞 You warrant that you are 18+ and not purchasing for anyone underage.

- [V. Retail Limits] -

BOOMM sets the following purchase limits per customer per day:

Delivery Orders:

📦 10 cases of beer

📦 36 bottles of wine

📦 24 spirits

We may cancel or reduce orders if we reasonably suspect multiple transactions are placed to bypass these limits.

- [VI. Delivery] -

For delivery details, please refer to boommalcoholdelivery.au/faqs. Estimated delivery times may be subject to external factors beyond our control.

Delivery Requirements:

✔️ Alcohol orders must be delivered to the named recipient (or nominee) at the specified delivery address.

🆔 An adult (18+) must be present at the delivery location and provide valid photo identification.

We will not deliver your order if:

❌ The recipient is intoxicated or is wearing a school uniform.

❌ We reasonably believe that the alcohol is being purchased for a minor.

❌ The recipient fails or refuses to provide valid identification.

If delivery is unsuccessful, your order may be cancelled, and a refund (minus delivery fees, if applicable) will be processed.

BOOMM records delivery details (e.g., ID verification, reasons for refusal) to comply with legal and privacy regulations.

- [VII. Fraud & Risk Assessment] -

BOOMM may conduct fraud checks before processing orders. If we cannot verify payment details, the order may be cancelled.

- [VIII. Risk & Title] -

⚠️ Risk: Risk transfers to you upon successful delivery.

🏷️ Title: Ownership transfers only when payment is received and the goods are delivered.

- [IX. Order Cancellations] -

By BOOMM:

We may cancel an order for the following reasons:

✔️ Out-of-stock items.

✔️ Payment failure.

✔️ Exceeding purchase limits (Clause V).

✔️ Suspected fraud or breach of terms.

✔️ Delivery failure due to non-compliance with Clause VI.

✔️ For cancellations by BOOMM, a full refund (minus delivery fees, if applicable) will be issued.

By You:

✔️ Orders can be cancelled if the status is “Order being processed” (contact Customer Service during operating hours).

❌ Once dispatched, cancellations are not guaranteed.

- [X. Fees & Charges] -

You agree to pay the listed product price at checkout.

✔️ You also agree to pay any additional fees or charges that are notified to you in advance.

✔️ Prices may change without notice, but the price for confirmed orders will not be altered.

- [XI. Returns & Refunds] -

Returns are not accepted once the order has been received by a verified recipient. If an incorrect item is delivered, or if the product is damaged or defective, please contact us immediately at hello@boommalcoholdelivery.au for refund or replacement arrangements.

- [XII. Account Suspension] -

BOOMM reserves the right to suspend or terminate accounts for violations of these Terms. Suspended accounts will not be permitted to place further orders.

- [XIII. Privacy & Communications] -

📧 By using BOOMM, you agree to receive service notifications and marketing emails (with an opt-out option available).

🔒 For details on how we collect and use your personal data, please refer to our Privacy Policy.

- [XIV. Intellectual Property] -

🔏 All content on the Site is owned by or licensed to BOOMM.

✔️ You must not copy, modify, or distribute any content without our prior written consent.

- [XV. Governing Law] -

These Terms comply with and are governed by the liquor licensing laws of New South Wales, Australia, along with other applicable Australian laws.

- [XVI. Changes to These Terms] -

BOOMM reserves the right to update these Terms at any time. Your continued use of the Site constitutes acceptance of the revised terms.

- [XXIII. Headings & Construction] -

The section titles in this Agreement are provided for convenience only and carry no contractual or legal effect.

The language of this Agreement shall be interpreted according to its fair meaning and shall not be strictly construed against either party.
